1. Acceptance of Terms

Welcome to EverUs! These Terms of Use ("Terms") establish the rules and conditions for accessing and using the EverUs mobile application, website, and related services (collectively, the "Platform"). By creating an account or otherwise interacting with the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.

The EverUs Platform is custom-built for couples to deepen their connection through shared memory journals, relationship games, chat features, and mood tracking. If you do not accept these Terms, please refrain from using the Platform.

2. Eligibility

You must be at least 18 years old to access and use EverUs. By using the Platform, you represent and warrant that you meet this age requirement. The Platform is only accessible in regions supported by the Apple App Store and Google Play Store.

3. Accounts and Registration

To access the full suite of features, you must register an account and may optionally link it with your partner by exchanging a secure invitation code. You agree to provide accurate registration details and to update them as necessary.

You are responsible for keeping your login credentials and invitation code secure. EverUs is not liable for unauthorized access resulting from a failure to safeguard this information. We reserve the right to suspend or terminate accounts that violate these Terms or provide false information.

4. Premium Subscriptions and Payments

While basic features of EverUs are available for free, certain premium functionalities require a paid subscription. Subscription plans and pricing are clearly displayed within the app.

  • Payment Processing: All subscription purchases are securely handled by third-party payment gateways (Apple App Store for iOS, Google Play Store for Android). We do not collect or store your payment details.
  • Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless deactivated in your Apple or Google account settings at least 24 hours prior to renewal.
  • Couples Access: In most cases, only one partner needs to subscribe to unlock premium benefits for the connected couple, provided the accounts are linked successfully.

5. Cancellations and Refunds

Because payments are processed directly by Apple and Google, EverUs cannot issue refunds or manage cancellations on your behalf. Any requests for refunds must be directed to the Apple App Store or Google Play Store, and are subject to their specific refund policies. You may cancel your subscription at any time through your device settings; you will retain premium access until the current billing cycle expires.

6. Platform Availability

We strive to provide continuous and reliable access to EverUs. However, the Platform may occasionally experience downtime due to planned maintenance, network disruptions, or unforeseen technical issues beyond our control. EverUs provides the Service on an "as-is" basis and does not guarantee uninterrupted functionality.

Subscription fees are non-refundable, and temporary service interruptions do not qualify for credits, refunds, or extended subscription time.

7. Account Inactivity and Data Retention

To optimize server performance and manage data responsibly, EverUs may deactivate accounts and purge data after extended periods of inactivity (e.g., no login or interaction for 12 continuous months).

  • Free Accounts: Shared memories, text, and media may be permanently deleted after 12 months of inactivity.
  • Premium Accounts: Data created during an active subscription will typically be retained for a grace period (e.g., 3 months) after the subscription lapses if the account becomes inactive. After this period, unused data may be subject to deletion.

We will attempt to notify users via email before permanently deleting data due to inactivity.

8. User-Generated Content

EverUs allows you to upload text, photos, chat answers, and game inputs ("User Content"). You maintain full ownership of all User Content you provide.

By using the Platform, you grant EverUs a limited, non-exclusive, worldwide license to host, store, and display this content specifically for the purpose of delivering the Service to you and your partner. You are solely responsible for ensuring your User Content is lawful, respectful, and does not violate the intellectual property or privacy rights of any third party.

9. Prohibited Conduct

To ensure a safe and positive environment, you agree not to:

  • Use the Platform for any illegal, fraudulent, or malicious purpose.
  • Harass, threaten, or abuse any individual.
  • Upload harmful code, viruses, or use automated scripts (bots/crawlers) to scrape data.
  • Attempt to reverse-engineer, decompile, or otherwise interfere with the underlying code and security architecture of the Platform.
  • Share content that is blatantly offensive, defamatory, or obscene.

Violating these guidelines may result in immediate account termination.

10. Intellectual Property

All proprietary designs, software, text, graphics, and features provided by EverUs are the exclusive property of our company. You are granted a limited, personal, non-transferable license to use the app as intended. You may not copy, reproduce, or create derivative works from our intellectual property without express written consent.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERUS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. THIS INCLUDES, BUT IS NOT LIMITED TO, LOSS OF DATA, SERVICE INTERRUPTIONS, OR TENSIONS AND DISPUTES BETWEEN PARTNERS STEMMING FROM IN-APP INTERACTIONS.

IN ALL CASES, THE TOTAL LIABILITY OF EVERUS SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID FOR THE SUBSCRIPTION IN THE 12 MONTHS PRECEDING THE CLAIM.

No Data Backup Guarantee
EverUs is a relationship journaling platform, not a primary data backup, secure cloud storage, or archiving service. While we strive to keep your data safe, we do not guarantee that your uploaded content (including photos, texts, and game data) will never be lost, corrupted, or otherwise rendered inaccessible due to technical errors, server crashes, or unforeseen events. You are solely responsible for maintaining independent, local backups of any cherished memories, photos, or important information you upload to the Platform. EverUs assumes no liability for lost data or the emotional distress associated with such loss.

Force Majeure
EverUs shall not be held liable or responsible for any delay, failure in performance, loss of data, or service interruption caused by circumstances beyond our reasonable control. This includes, but is not limited to, acts of God, natural disasters, cyberattacks, hacking, ransomware, malware, labor strikes, telecommunications or internet service provider failures, and outages or disruptions of third-party infrastructure and hosting providers (such as Google Cloud or Firebase).

Class Action Waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND EVERUS AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You expressly waive your right to file or participate in any class action lawsuit, class-wide arbitration, or consolidated claims against EverUs and its developers.

Severability
If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable by a court of competent jurisdiction, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

12. Indemnification

You agree to indemnify and hold harmless EverUs, its developers, and affiliates against any claims, damages, liabilities, and expenses arising out of your violation of these Terms, your misuse of the Platform, or the infringement of any third-party rights by your User Content.

13. Modifications to Terms

EverUs reserves the right to modify these Terms at any time to reflect new features, legal changes, or business practices. Updates will be posted on this page, and continued use of the Platform signifies your acceptance of the revised Terms. If you disagree with any changes, you must discontinue using the app.

14. Governing Law

These Terms and your use of the Platform shall be governed by and interpreted in accordance with applicable general consumer protection laws, without regard to conflict of law principles. Any legal proceedings related to the Platform shall be resolved in the competent courts within our primary jurisdiction of operation.
